I had applied on July 19th to Nebraska. My I-140 was approved from TX.
Today I received transfer notice WAC...., mentioning that they have transferred my case to TX Service center.
The receipt date is of Sep 14th, Notice date of Sep 17th'2007.
Does it mean I lost the original filing receipt date of July 20th'2007.

Hi,
I got a RFE while doing my H1B transfer under premium processing. They have stated to respond within 60 days. Does anybody have an idea as to whether it takes so long or it gets resolved soon under premium processing? Please help.

Guys,
I have another dumb question.
If you apply for COS from US for conversion from H4 to F1 and if the course study falls under TAL then will the COS procedure will take more than normal time? Have anyone experienced this before?
Thanks in advance for your help.

USCIS has reminded all applicants for Adjustment of Status, Asylum, Legalization and Temporary Protected Status to obtain an Advance Parole (AP) document before traveling abroad. AP allows an applicant to re-enter the U.S. after traveling abroad.
In order to obtain Advance Parole, individuals must file Form I-131, Application for Travel Document to USCIS. The USCIS cautions individuals planning on traveling abroad to file Form I-131 well in advance of their travel plans (approximately 90 days before) in order to prevent possible conflicts.
We suggest all applicants of I-131 to file it in time to get the AP approval before leaving the U.S., otherwise it could have dire consequences and may result in an individual not being able to re-enter. Therefore, individuals that have a pending I-485 are encouraged to apply for Advance Parole before traveling abroad for easier re-entry if the circumstances of their current status changes.

Gurus,
I am moving 60 miles from where I live now. I am planning to do following two things.
1. File a Form AR-11
2. Call this number (800) 375-5283 for pending I-485 and EAD renewal applications for self and spouse
Do I need to update the address on approved AP/I-140/EAD or any other approved applications as well.
Am I missing something
Please advice....Thanks :)

Can a Saturday or a Sunday be a "business day"? It depends on who you ask. The U.S. Department of Labor says yes, while the Department of Homeland Security thinks otherwise. What's an employer to do? On October 12, the Board of Alien Labor Certification Appeals (BALCA) issued a decision "In the Matter of Il Cortile Restaurant". This case involves a PERM application for a chef, and has been bouncing around in the Labor Department (DOL) for three years. In May 2007, the employer posted a Notice of Filing (NOF) of a PERM application for ten consecutive days. The Certifying...

Lots of activity to report. Congressional Hispanic Caucus leaders met this week with President Obama who said he wants a vote during the Lame Duck and would work the phones to round up votes. Harry Reid tweeted today that he'll offer the DREAM Act as a standalone bill which will hopefully help bring along a few of the "procedural" no voters from last September who indicated they like the DREAM Act but didn't believe in tacking it on to a budget bill. In the mean time, advocacy groups are apparently still arguing about the final language including answering whether college...

PERM (labor certification) process is a requirement from the DOL and has to be fulfilled by the employer. The employer will have to bear the costs of this first step in GC which includes (filing fees, recruitment process, lawyer fees etc). It is illegal for an employer to seek this compensation from the employee. Expenses incurred in I-140 and I-485 need not be compensated by the employer.
In your case, it seems that the employer is ready to help you with all the documentation but is not ready to bear the expenses. You will have to explain to your employer how the GC Process works and the requirements of the PERM process.

Hi Gurus
I have a 4 year Indian Bachelor degree and 5 years of IT experience.
Of my 5 year experience
4 years is for My Company (India) Ltd
1 year is for My Company (US) Ltd.
Will my total experience be treated as progressive and can I process in EB2 category?
Kindly answer my query? Thanks in advance.

In our December 2009 newsletter, we explained how the employment-based (EB) priority date system works. See http://shusterman.com/dec09.html#4 In this article, we provide you with materials which may make it easier for you to estimate when you will be able to adjust your status (AOS) and become a permanent resident. First of all, how many people have pending applications for AOS in the EB categories? The USCIS states that, as of September 23, 2009, there were 234,000. Of this total, 75,000 were in the EB-2 category and 151,000 were in the EB-3 category. Of course, not all persons with EB priority...

Hi, guys:
My friend filed I-140 and I-485 concurrently on 8/6/2007. His lawyer just got a rejection letter (not RFE) from INS due to the I-140 filing fee problem: The expected filing fee is $475 and the check in his filed package is $425. It is a $50 different. Does anybody have the similar situation as my friend ? And
how do you guys handle this prolem ? Any suggestion is appreciated.
Thanks

I was listening to BBC News last night and heard an interview with a scientist described as one of the world's leading experts on climate change. That scientist is Indian-born Ram Ramanathan, Distinguished Professor of Atmospheric and Climate Sciences at the Scripps Institution of Oceanography at the University of California in San Diego. He recently won the Tyler Prize which is awarded to the top environmental scientist in the world. UCSD describes Ramanathan: One of the world's leading atmospheric scientists, Ramanathan was the first to show that ozone-depleting aerosols could aggravate the greenhouse effect. In 1980, he correctly predicted that...

As the prospects for Immigration reform are becoming more of a reality, so does the debate about illegal Immigration is more real than ever. A story just came in from CNN an Arizona man caught leaving water bottles in the desert for illegal immigrants has been sentenced to 300 hours of community service and a year of probation.
Walt Staton, a member of the group No More Deaths, left full water bottles in December in Buenos Aires National Wildlife Refuge for the illegal immigrants who routinely pass through the 18,000-acre refuge. Read more here (http://www.cnn.com/2009/CRIME/08/13/arizona.immigrant.advocate/index.html)
As the Immigration debate heats up this summer, expect more stories like this one.
