You can apply again if you have a new employer, or even if the same employer will reapply. However, if you were denied for a reason that is still a problem, such as not having the required degree or experience equivalent, there is no point in reapplying. Good luck.

Will try to shorten the story.
I was with ABC consulting company and had applied for GC (and got perm and 140 approved). My contract with client ended. Though ABC were good but they could not get me a project so I had to shift to another company. I talked to ABC to get my GC proceeding with extra cost. They said (and attorney also) said my 485 has been filed. As the ABC had changed their name also, as notification for I-140. They also insisted to join back.
My new company layoff quite a lot of people. Needless to say, me also. Now my easy option is to join them back, but is there any possibility that to make me continue to work for them, they can do mess up in GC process?
May be question is quite personal, please suggest whatever cmes to your mind.

I have a pending I- 485 in EB2 and My spouse has a pending 485 in EB3 since 2007. We both are using EAD and on AOS. We got married recently, and my PD became current now.
What is the best way to make use of this situation and add my spouse to my pending 485?
Do we have to file another fresh I - 485 or is there a way to link his EB3 485 application with mine?
If I have to file a new 485, what are the documents needed apart from Marriage certificate, Since my spouse is already on EAD and working, Do I still have to send affidavit of support, my pay slips, w2, EVL etc.? Do we have to send medicals again? Kindly clarify my questions. Help is appreciated.

It is better to wait to switch after your I-140 approval ....
If you switch before, your employer could cancel the application or might not answer RFE if one is issued ...

It would be risky.F-1 visa requires strong ties to homeland. Since your parents are already here, it would be difficult for you to prove that you will indeed go back to India on completion of your studies.

Dear experts/Attorneys,
Please help me. My EB2 priority date in 21Nov 2007. My I 140 is approved and yet to file for I 485. Now at work I have promotion offer from Sr developer to Team lead. Technologies I work for won't change, but I have to change my work location to different state in this case
do I have to file for PERM and I 140 again?
If I have to file 140 can I retain priority date?
Is there any other option for me to escape PERM refiling other than not accepting promotion :)?
Your advice is greatly appreciated.

Is there anyone whose I485 is pending for more than 90 days. My I-485 was sent on July 18th. I called USCIS twice and they are asking me to call them on Oct 17th (when 90 days is completed). They are saying that my appl.n should be in by then. Is there any one whose checks got cleared after 90 days. If not, what did you do about it.

Hi,
My husband is on H1-B, and it expires on Feb 4th 2007. We plan to go to India, leaving the U.S. on Feb 11th 2007. His current I-94 expires on Feb 4th 2007.
We have our I-140 and 485 filed in parallel. He has received his EAD and Advanced Parole.
His lawyer wants to apply for H1-B but not use premium processing, as he can re-enter the U.S. using Advanced Parole.
Now, our concerns are these:
1. If he leaves the U.S. AFTER the expiration of his current I-94 WITHOUT having a new I-797, can it look as if he overstayed?
2. If he re-enters the U.S. using the Advanced Parole, will that change his status so that he is now considered to be on immigrant(EAD) rather than non-immigrant (H1-B) status?
Basically, we want to insist on premium processing and go for the H1-B visa stamp while in India to be sure that he does not go out of status.
Any advice on this?

For those of you who either are residents (Citizens or PRs) or Canada or have been thinking about becoming residents of Canada but working in US, please share your experience in terms of:
1. How you maintain your residency (or non-residency) in both countries.
2. What are the tax implications if you maintain residency in both countries,
specially if you own property in Canada.

For EAD applications that have been pending for more than 90 days, an interim EAD card can be issued. Hi,
I have my EAD/AP. I'm EB3-I.
I paid my attorney for the 485 processing. But the law firm works for my company.
They have been good so far (law firm) but I guess it would be better for me to first change the attorney If I plan to file AC21.
I would appreciate it if someone can suggest me good attorney . What would be the fee I can be looking at to pay the new attorney at this point of my GC. processing( With EAD/AP ..renewal also taken care.)
(If it is not appropriate to mention the figure I would appreciate it if someone can just give me a range/ballpark figure)
